The parties to this action – the Plaintiffs (on behalf of themselves and the Class),
and Defendant Skadden, Arps, Slate, Meagher & Flom Pension Plan (“Defendant” or
“Plan”) – reached an agreement to settle a lawsuit filed in 2007 challenging the
way between 1992 and August 17, 2006 the Plan calculated the lump sum payouts of
the pension benefits earned by some 1,000 former employees of Skadden, Arps, Slate,
Meagher & Flom LLP and Affiliates (“Skadden” or the “Firm”).
The settlement was approved by the Honorable P. Kevin Castel in an Order dated June 5, 2009. There were no objections to the
settlement.
The settlement will not become final until 30 days following the date June 5 Order is entered on the docket. The Plan will begin processing
payments as soon as that occurs.
Defense Counsel is not currently aware of any appeals being taken from the Order entered June 8, making July 15, 2009 the “Effective
Date” of the Settlement barring any intervening events of which Defense Counsel
is presently unaware. The Plan is therefore to use best efforts to pay the settlement
proceeds by August 14, 2009, and currently plans to send checks/process rollovers
during the first two (2) weeks of August.
